Kudos to David for going after the slimy, underhanded tabloid media. The Daily Mail has issued this apology to David and his family:

On October 19, an article about actor David Duchovny may have suggested he had an amorous relationship with a tennis coach, Edit Pakay.

We now accept this is inaccurate and Ms. Pakay and Mr. Duchovny are only friends who used to play tennis occasionally.

Their relationship went no further and was not a factor in Mr and Mrs Duchovny’s separation. We apologize to Ms. Pakay, Mr. Duchovny and to Mr. Duchovny’s family.

David Duchovny has opted to serve first.

The recently separated Californication star sued Britain’s Daily Mail for defamation Wednesday over the tabloid’s report last week that Duchovny cheated on his wife, Téa Leoni, with a tennis instructor.

The Mail went ahead and posted the item online despite being told “point blank” that the story was false and that the alleged object of this adulterous affection was “explicitly and specifically denying a romantic or sexual relationship with David Duchovny,” according to court documents filed today in Los Angeles Superior Court. “By its intentional and reckless conduct, Daily Mail has caused substantial harm to Duchovny, in complete disregard of the truth and of even a semblance of journalistic integrity,” the suit states.

The story—published Oct. 18 and accompanied by the salacious headline “‘An affair? I’m not going to deny it’: Tennis coach tells of her close friendship with ‘sex addict’ David Duchovny as he splits from wife”—stated that the 48-year-old actor had “a full-blown sexual affair” with 28-year-old tennis pro Edith Pakay, that their professional relationship “quickly turned into a love match.”

Pakay, meanwhile, told E! News last week that she and Duchovny were playing partners and friends—and nothing more.

“There is no romance, and we are just friends,” the 28-year-old, Hungarian-born instructor said. “No love, nothing. That is all I have to say.”

Duchovny’s lawyer, Stanton “Larry” Stein, also told E! that Pakay has signed a sworn declaration that the former X-Files hunk does not have romantic feelings for her, nor she for him.

“The last time that I met up with David Duchovny was almost a year ago, in November 2007, when we made plans to play tennis. His personal trainer was also with us. Since November 2007, I have not seen David Duchovny, other than running into him briefly at the gym in March 2008 where he was working out,” she stated.

Duchovny is seeking at least $1 million in damages from the London-based Mail.

The Golden Globe winner sought treatment in August for a sex addiction, prompting much speculation into the true state of his 11-year-plus marriage to Leoni. His attorney confirmed earlier this month that Duchovny was out of rehab and asking for his family’s privacy.

He and Leoni revealed a week ago that they have been separated for several months.

Though David Duchovny and Téa Leoni confirmed that they have been separated for several months, a source who knows the couple says they still appear close and friendly.

“They get along great together,” says a source in their New York City neighborhood.

“They are such a nice family, so down-to-earth,” the source adds. The family was seen together at the Czech Street Festival in Manhattan earlier this month.

Duchovny, 48, and Leoni, 42, were married in 1997. They have two children, daughter Madelaine West, 9, and son Kyd, 6.

Speaking to PEOPLE last week, before the separation announcement and following Duchovny’s release from rehab for sex addiction, Gossip Girl star Madchen Amick (who will appear on Duchovny’s Showtime series Californication later this season), told PEOPLE: “I know that his family is really important to him, and he always speaks fondly about them. The only hard part about doing the show [in California] is being away from them. But I know he really adores them.”

Duchovny is currently preparing for an upcoming starring role in The Joneses, also starring Demi Moore.

David Duchovny has checked out of a rehabilitation center for sex addiction, according to his lawyer, Stanton “Larry” Stein.

“David is out of rehab and about to start a new movie,” Stein tells PEOPLE. “He successfully completed his treatment.”

The actor, 48, voluntarily entered a facility to treat the addiction in August, Stein told PEOPLE at the time.

Duchovny has been married to actress Téa Leoni since 1997. They have two children, daughter Madelaine West, 9, and son Kyd, 6.

“I have voluntarily entered a facility for the treatment of sex addiction,” Duchovny said in a statement released Thursday by his attorney, Stanton “Larry” Stein. “I ask for respect and privacy for my wife and children as we deal with this situation as a family.”

The 48-year-old X-Files star—who, ironically, won a Golden Globe this year for playing an over-sexed struggling writer on Showtime’s Californication—has been married to Téa Leoni since May 1997. They have two children together, daughter Madelaine West, 9, and son Kyd Miller, 6.

“All of us at Showtime wish David and his family the best during this very private time,” Richard Licata, the network’s executive VP of Corporate Communications, said in a statement to E! News.

The second season of Californication, premiering Sept. 28, finished shooting late last month and 12 episodes are ready to go.

Though it may have been awhile, this isn’t the first time Duchovny’s sex life has turned into a talking point.

“I’m not a sex addict,” he said in an interview with Playgirl in 1997. “I have never been to those meetings. It’s hurtful to my family and if I was involved with a woman in a monogamous relationship, it would be hurtful to her.

“There was another story claiming I was a neat freak. If I had to choose one of the two, I think I’d rather be a sex addict. It’s not funny and I’ll be glad when it goes away.”

Uncomfortably enough, Leoni herself quashed a rumor that her hubby was afflicted with a sex addiction back in May of 1998, telling Elle that she found the notion “very exciting.”

“David was accused of being a sex addict,” Leoni, who had been married for one year at that point, said. “Which I always found very exciting. And then I found out it wasn’t true.”

“Men are like bulls,” she continued. “They gotta get the new cow. Maybe you’ve got to get the bull after he’s had a lot of cows, so you might just be the last new one.”

David Duchovny and wife actress Téa Leoni are moving to New York. They’ve listed their 6,578-square-foot Malibu ocean-view home for $12 million and expect to be settled back East before their children return to school in the fall.

Leoni has been itching to move back East for some time now, and the Malibu fires — their home was not damaged but was in the mandatory evacuation zone — tipped the scales for her, sources say. The two-story house being sold has two swimming pools — one a regulation lap pool. There are five bedrooms, four bathrooms and a separate gym. The 5 1/2 -acre property includes membership in the La Costa Beach Club. There is a two-room guesthouse over a three-car garage. The house was built in 1996.

The property sits two doors from one bought earlier this year by country singer Kenny Chesney. He paid $7.4 million and then put the house back on the market at $7.95 million about six weeks later. It remains unsold.

by our medical system in Canada and we, her community, have gathered

this end we have organized a number of fund raising events to help
